Please read these Terms of Service ("Terms") carefully. By accessing or using the Bitekia platform, you agree to be bound by these Terms and all applicable laws and regulations in India.
1. Nature of the Platform
Bitekia is exclusively a Technology Intermediary. We provide a Software-as-a-Service (SaaS) digital ordering and kitchen management system for independent restaurants, cafes, and dining establishments.
- We are not a restaurant, food preparation entity, or food delivery service.
- We do not employ the kitchen staff, servers, or management of any partner restaurant.
- We are not responsible for the preparation, quality, safety, or pricing of any food or beverages ordered through our platform.
2. User & Restaurant Obligations
When a User places an order by scanning a Bitekia QR code, they are entering into a direct commercial contract with the specific Restaurant providing the service.
The Restaurant is solely responsible for fulfilling the order, handling dietary restrictions (including severe allergies), and ensuring compliance with all local health and safety regulations. Users must direct any complaints regarding food quality, service delays, or health concerns directly to the Restaurant management.
3. Restaurant Partner Agreement
By registering as a Restaurant Partner on Bitekia, you agree to the following operational responsibilities:
- Regulatory Compliance: You are solely responsible for holding valid food safety licenses (e.g., FSSAI) and complying with all local health, sanitation, and municipal regulations.
- Tax & Financial Liability: Bitekia provides software infrastructure. The Restaurant is strictly responsible for all tax calculations (e.g., GST), invoicing, and tax remittances associated with food sales.
- Data Protection: You may have access to customer data (e.g., phone numbers for order verification). You agree to use this data strictly for fulfilling the current order and are legally prohibited from extracting, storing, or using this data for marketing or third-party sharing without explicit user consent.
- Intellectual Property & Menu Accuracy: You warrant that you own or have the licenses to all food imagery, logos, and descriptions uploaded to the platform. You are entirely liable for the accuracy of menu prices, dietary labels, and allergen information. Bitekia holds zero liability for customer allergic reactions resulting from inaccurate menu descriptions.
- Age-Restricted Items (Alcohol & Tobacco): If your establishment utilizes the platform to list age-restricted items, you acknowledge that Bitekia acts solely as a digital menu catalog. Your on-premise staff retains 100% of the legal obligation to manually verify government-issued identification before serving such items to the user.
4. Limitation of Liability & Indemnity
To the maximum extent permitted by applicable Indian law, Bitekia and its affiliates, directors, or employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or goodwill.
Bitekia specifically disclaims all liability arising from disputes between Users and Restaurants. By using this platform, both Users and Restaurant Partners agree to fully indemnify and hold Bitekia harmless from any claims, damages, liabilities, or legal actions resulting from the dining experience, food preparation, or platform usage.
5. Platform Availability & Force Majeure
We strive to ensure 99.9% uptime for the Bitekia ordering cloud. The platform is provided on an "AS IS" and "AS AVAILABLE" basis. While Bitekia implements rigorous security standards in compliance with the Information Technology Act, 2000, we do not provide absolute warranties that the service will be entirely uninterrupted or immune to the inherent transmission risks of the public internet.
Force Majeure: Bitekia shall not be held liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, national internet back-bone failures, telecommunication outages, severe cyber-attacks, or third-party server collapses (e.g., AWS/GCP outages).
